BRENTANI RONCOLATTO ADVOGADOS, a law firm duly registered with the CNPJ/ME under no. 05.376.620/0001-43 (“BRA”), as Personal Data Controller, makes this Privacy Policy available with the aim of demonstrating our commitment to your privacy and protection of your Personal Data and so that You, as Data Subject, have a clear understanding of how BRA uses and processes this Personal Data.

1. When and to whom does this Privacy Policy apply?

This Privacy Policy is applicable to the processing of Personal Data carried out by BRA during your browsing on our website (https://brentanironcolatto.adv.br), when you contact us to send your CV and other data, seeking an opportunity to work with us, when you sign up to receive our In Practice newsletters, or other newsletters or when we provide legal services to You (“Services”).
This Privacy Policy also applies to everyone who has, in any way, their Personal Data processed by BRA and it aims to inform and make you aware of how this Personal Data is treated and how You can exercise your rights as Data Subject.

2. Definitions

Controller: natural or legal person governed by public or private law, who is responsible for decisions regarding the processing of Personal Data;

Personal Data: information related to an identified or identifiable natural person;

Sensitive Personal Data: Personal Data on racial or ethnic origin, religious conviction, political opinion, membership of a trade union or organization of a religious, philosophical or political nature, data relating to health or sexual life, genetic or biometric data, when linked to a natural person;

LGPD: General Data Protection Law (Law No. 13,709/2018);

Data Subject: natural person to whom the Personal Data that is subject to Processing refers;

Processing: any operation carried out with Personal Data, such as those relating to collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, diffusion, or extraction.

3.1. You are aware that you will not be able to insert Sensitive Data at the “Contact” collection point on our website. If you provide any Sensitive Personal Data, your message will be automatically disregarded and discarded, and your request will not be fulfilled.

4. Personal Data Sharing Situations

4.1. The Personal Data processed will not be published or sold in any form or by any means to third parties, except with your prior and express consent, or by force of Law, court or government authority order.

4.2. However, we may share Personal Data with third-party suppliers or service providers to BRA, such as, hosting providers, software as a service providers, cloud storage providers, accountants, paralegals, forwarding agents, translators, courier companies and other subcontractors.

4.3. Said third parties will receive the collected data only and solely for the fulfillment of the purposes for which they were collected, and they must ensure protection of Personal Data and privacy in the same way as BRA.

4.4. BRA may also, observing the applicable legal basis, share collected Personal Data with competent judicial, administrative, or governmental authorities, whenever there is a legal determination, order, request, court order or when necessary to respond to questions or investigations or for the defense of your interests.

4.5. We may also share your Personal Data in the event of BRA’s corporate restructuring, such as merger, spin-off, incorporation or in other cases of transfer of control.

5. Links to Third Parties’ Websites

We may present content with links to third-party websites or applications and third-party accounts on social media. In this case, You must read the respective privacy policies and terms of use to find out how these third-parties collect and process your Personal Data. BRA is not responsible for the processing of Personal Data carried out by third parties, nor for the content conveyed by them.

6. Cookies

6.1. Cookies are small text files stored in your browser or device that allow the automatic collection of data, for example, for recognition of user authentication details and administration area settings, to adapt the website and its navigation to your needs specific. Thus, the information saved in this text file helps the website to recognize the user and their browser when accessing it again.

6.2. Cookies in relation to their storage time in your browser can be: (i) persistent, that is, they remain resident on your device for a certain period of time or (ii) of session, that is, temporary cookies that are deleted from the your device when the browser is closed. Our website uses both types of cookies.

6.3. You can view and delete cookies through your browser settings or install a program that performs this functionality. However, when doing so, some areas of our website may not function properly.

7. Your rights as Data Subject

7.1. In relation to the processing of Personal Data, You may request the following information or measures:

  • Confirmation of the existence of Processing or access data;
  • Correction of incomplete, inaccurate or outdated data;
  • Anonymization, blocking or deletion of unnecessary, excessive or non-compliant data;
  • Portability of your Personal Data to another service or product provider, provided that commercial and industrial secrets are observed;
  • Revocation of consent;
  • Deletion of Personal Data processed with the Data Subject’s consent;
  • Obtaining information about the public or private entities with which BRA shared your Personal Data;
  • Information about the possibility of not providing consent and the consequences of refusal;
  • Express opposition to the Processing of your Personal Data carried out based on a legal basis other than consent.

7.2. You may request to BRA’s Data Protection Officer to confirm the existence of Personal Data Processing and/or any of the measures listed above, via the contact email indicated below. 

7.3. We emphasize that requests made cannot always be met by BRA. However, if it is impossible to take a measure, we will indicate the processing agent responsible for the Treatment or we will present the reasons that prevent the immediate adoption of the measure, so that you may understand our reasons. 

7.4. If You request the deletion of your Personal Data, the data may need to be maintained regardless of the deletion request in order to comply with legal or regulatory obligations and whenever necessary for our judicial or extrajudicial defense, as allowed by applicable Laws.

8. International Transfers

We process and store Personal Data in Brazil. However, we use the services of third-party providers, such as our platform hosting service and cloud storage service, and in some cases these third parties may store Personal Data abroad. In this case, BRA guarantees that Personal Data will only be sent to countries whose level of Personal Data protection is adequate and in accordance with the provisions of the LGPD.

9. How your Personal Data is protected?

9.1. Personal Data and other information collected will be stored in a secure environment, subject to the available state of the art, and may only be processed by qualified people authorized by BRA and only to fulfill the purposes for which the Personal Data was collected.

9.2. The Personal Data to which we have access may be accessed by BRA employees or subcontracted partners when strictly necessary to fulfill the purposes set out in this Privacy Policy, such as information storage service providers. We seek to require all our subcontracted partners to maintain adequate standards in privacy and data protection and to comply with contractual provisions and/or rules established by BRA regarding the protection of Personal Data.

10. How long can we keep your Personal Data?

10.1. Your Personal Data will be processed and stored for the time necessary to achieve the purposes stated in this Privacy Policy, or until You exercise your rights to object to the Processing, or revoke consent, when applicable.

10.2. To the extent that the purposes are achieved or You exercise some of your rights, your Personal Data will be deleted, except in the cases provided for in the legislation in which BRA may keep your data, such as: a) compliance with legal or regulatory obligations; b) protection of BRA’s rights; c) to comply with court orders; d) for the defense of BRA in and out of Court, subject to the applicable statute of limitations.

This Privacy Policy may be updated at any time by BRA, so that it always reflects in the clearest and most accurate way the Processing of Personal Data that we carry out in BRA. Therefore, we recommend that You re-read this Privacy Policy from time to time, so that you are always aware of the terms set out here.
